Membership on the Website is free for buyers. Lokayatan Publication does not charge any fee for browsing and buying on the Website.

Lokyatan Publication Returns policy applies to all Lokyatan Publication products(Books).

GENERAL RETURN POLICY

Lokyatan Publication will accept 100% return of its products without prior authorization within 1 months of original purchase provided that the following conditions are met:

1. Products are returned prepaid in new, unmarked, and resalable condition
2. CD-ROMS, Combo’s or other shrink wrapped packages are not returnable if shrink wrap is broken.
3. Out of Print (OP) product will be accepted for full return if received within 30 days of being declared OP. After 30 days, credit will not be issued and product will not be returned to the customer. Returns of older editions will be credited if received within 90 days of the publication of a new edition.
4. Shortages, damages, or defective product claims should be reported within 30 days of invoice.
5. A Customer Account #, Invoice #, and date of purchase by line item should be included within the returned shipment. A Lokyatan Publication invoice or packing list is preferred to ensure proper crediting.
6. Product should be returned in corrugated cartons (275 pound test, 45 lbs per carton). Fill voids to protect all items. Do not use newspaper as packing materials. Do not stack on edge of bindings.
7. See the DIGITAL PRODUCTS PURCHASED ONLINE FROM LOKAYATAN PUBLICATION and CREATE/CUSTOM PUBLISHING TITLES policies below.

CREATE/CUSTOM PUBLISHING PRINT TITLES

• Create/Custom Publishing print titles are limited to 10% of total combined invoices for a Specific title within a 6 month period and must be returned within 6 months of Invoice date. This exception to the general return policy does not apply to Create or Custom Publishing eBooks; please see the Digital Products policy below. If the title is still in print, returns in excess of 10% will not be credited and will be returned to the customer at the customer’s expense. If the title has been declared OP and a return is in excess of the 10% limit, a credit will be issued for up to 10% of invoiced amount. Credit will not be issued for returns of OP titles over the 10% limit nor will these titles be returned to the customer.

Please note that:

• Returns will only be accepted for product originally purchased from Lokyatan Publication. Product purchased from other sources (wholesalers, publishers, distributors) will not be credited and will be subject to return to the customer at customer’s expense.
• Used Books, price stickered, security label/tagged product, water damaged or other types of damaged product are ineligible for credit and are subject to being returned to the customer at the customer’s expense.
• Partial credits or refunds are not given for Cancellation or Return of any individual component contained within a product package.
• All associated shipment and handling costs are non-refundable and are the responsibility of the customer.

DIGITAL PRODUCTS PURCHASED ONLINE FROM LOKAYATAN PUBLICATION

• Customers will receive a full refund or be allowed an exchange for digital products accessed online and purchased directly from Lokyatan Publication if returned within 7 days of purchase. Digital products, which are purchased as an access card or which are downloadable, such as certain eBooks, are not eligible for return. To obtain a refund, the customer will be required to supply their order and online access code information to Customer Service.

This agreement between you and Lokayatan Publication explains how you can use our Web sites and buy products listed on our Web sites. Use of Lokayatan Publication Web sites is governed by this agreement. By registering as a Lokayatan Publication customer, you acknowledge and signify that you have read, understood, and agreed to be bound by this agreement.

1. Who is Lokayatan Publication?

Lokayatan Publication operates a number of Websites, including but not limited to Educaste.com (collectively the “Web sites”) that allow registered Lokayatan Publication customers (“Customers”) to purchase digital and physical forms of books written by different writers on different topics.

2. Who Can Be a Customer?

Only individuals and businesses that are legally entitled to enter into legally binding and enforceable contracts may register to be a Customer and purchase items through the Websites. Customers must comply with all applicable laws.

All information submitted by Customers through the Web sites, including registration information, payment information, and transaction-related information must be true, accurate, current, and complete.

Once you have registered as a Customer, you are referred to as a “Customer”, “You”, “Your” or “Yourself” for the purposes of this agreement.

3. How This Works

Lokayatan Publication and related author reserved the rights of all the books displayed on our website.

A variety of payment methods (including credit cards) may be used to purchase on our Web Sites. Passwords must be kept confidential and not disclosed to or shared with any other person. You are solely responsible and liable for any use and misuse of Your password and for all activities that occur under Your password. You must immediately notify Lokayatan Publication of any unauthorized use of Your password, or if You know or suspect that Your password has become known to any other person. Lokayatan Publication is not under any obligation to verify the actual identity or authority of the user of any password.

4. Buying on behalf of a Third Party

If a Customer places an order on behalf of another person, this third party’s contact information must be communicated to the Seller, along with the Customer’s information. A seller is not required to communicate with the person that an order was placed on behalf of.

5. Misprints and Orders

Although Lokayatan Publication strives to provide reliable and current information on the Web sites, misprints or other errors may occur. Lokayatan Publication reserves the right to change information on the Web sites at any time and from time to time without any notice or liability to You or any other person.

Items listed on the Web sites are subject to availability, and may not be available when ordered or afterward.

The Items offered on the Web sites are invitations for purchase orders, and shall not constitute binding offers to sell. Your properly completed and delivered order form constitutes Your offer to purchase the Items referenced in your order. Your order will be accepted only if and when the Lokayatan Publication sends an order acceptance and shipping notice to Your e-mail address.

6. We Respect Your Privacy

Your personal information will be collected and saved by Lokayatan Publication. All data and information collected from You by Lokayatan Publication is treated confidentially respecting the applicable laws on data protection and in accordance with our Privacy Policy.

7. Warranty Disclaimer and Liability Exclusion and Limitation Clauses

Since Lokayatan Publication is not a party to any transactions through the Web sites, Lokayatan Publication does not give any representation or warranty regarding any transactions or any of the Items. Lokayatan Publication has no control over or liability for the quality or legality of the items advertised, the truth or accuracy of the listings, or the ability of Sellers to sell items.

The Web sites are provided on an “as is” and “as available” basis, and without any representations, warranties or conditions of any kind, whether express or implied, and including without limitation implied conditions, warranties or representations of merchantability, fitness for a particular purpose, performance, durability, security, availability, or accessibility, all of which are hereby disclaimed by Lokayatan Publication to the fullest extent permitted by law.

Regardless of the nature of the claim or the reasons for the loss and damages, Lokayatan Publication’s liability is limited to foreseeable and typical damages. Lokayatan Publication will not under any circumstances be liable to You for any loss of use, loss of production, loss of income or profits (anticipated or otherwise), loss of markets, economic loss, special, indirect or consequential loss or damage or punitive damages, whether in contract, tort or under any other theory of law or equity, arising from, connected with, or relating to the use of the Web sites by You unless it concerns the loss of life, injury of body and/or physical health.

In no event will Lokayatan Publications’ total liability to You or any other person for any claims, proceedings, liabilities, obligations, damages, losses, and costs, whether in contract, tort or under any other theory of law or equity and regardless of any negligence or other fault or wrongdoing by Lokayatan Publication or any person for whom Lokayatan Publication is responsible, exceed the lesser of INR100 or the purchase price of the item that is the subject of the claim.

The exclusion of certain warranties and the exclusion or limitation of certain liabilities is prohibited by law in some jurisdictions. Such limitations may apply to You. The warranty disclaimer and liability exclusion and limitation clauses survive indefinitely after the termination of this agreement.

8. Legal Claims

For all disputes between Lokayatan Publication and you or any other person arising from, connected with, or relating to the Web sites, this Agreement, transactions facilitated or conducted through the Web sites, Items ordered or purchased through the Web sites, dealings between You and Lokayatan Publication, or any related matters or any legal relationship associated therewith or derived therefrom (“Disputes”), the relevant parties will attempt to find a reasonable solution least onerous to the parties. If a Dispute cannot be resolved by the parties, then the Dispute must be resolved before the Courts of India sitting in the City of Allahabad, Uttar Pradesh, India, and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of those courts in respect of all Disputes. Proceedings regarding Disputes must be commenced in a court of competent jurisdiction in the City of Allahabad, Uttar Pradesh, India within six (6) months after the Dispute arose, after which time any and all proceedings regarding the Dispute are barred. Any shorter time limit provided by statute law remains unaffected.

9. How Do You or Lokayatan Publication End This Agreement?

You can delete your account by navigating to settings page in our Commerce and Finance app on Play Store. All the data related to your account will be deleted.

You or Lokayatan Publication may terminate this Agreement at any time with immediate effect and without any prior notice. Lokayatan Publication may at any time and in its discretion immediately suspend or terminate (in whole or in part) your permission to use the Websites without any notice or liability to You or any other person.

If this agreement or your permission to use the Web sites is terminated by You or Lokayatan Publication for any reason, this agreement will nevertheless continue to apply and be binding upon You in respect of Your prior use of the Websites and prior purchases of Items through the Web sites and anything connected with, relating to or arising from those matters.

10. Changes to Web sites, Policies and Procedures, and this Agreement

Lokayatan Publication may, in its discretion, change, suspend or terminate, temporarily or permanently, the Web sites or any part of them at any time, for any reason, without any notice or liability to You or any other person.

Lokayatan Publication may, in its discretion, change, supplement or amend its policies and procedures and this agreement as they relate to future use of the Web sites from time to time and without any notice or liability to You or any other person, by posting revised documents on the Web sites. You may not change, supplement or amend this agreement or any Lokayatan Publication policies or procedures.

You and Lokayatan Publication have expressly requested and required that this Agreement and all other related documents be drawn up in the English language.
